President Dr Mohamed Muizzu has ratified the First Amendment to the Tobacco Control Act, introducing stringent new measures to regulate the use of tobacco in the Maldives. The amendment, which was passed by the Parliament on 12 November 2024, focuses on banning electronic cigarettes (e-cigarettes) and tightening restrictions on tobacco sales.
The newly enacted law explicitly prohibits the import, sale, distribution, and use of e-cigarettes, vaping devices, and related products across the country. This ban on vaping products will come into effect on 15 December 2024, while other provisions of the law are effective immediately from 15 November 2024.
Key provisions of the amendment include:
- No tobacco use in government buildings: The law bans smoking in all government institution buildings and their premises. Violations will result in fines for both users and property operators, with potential suspension of smoking permits and business licences.
- Stricter age verification: Retailers are now required to verify the buyer’s age through ID checks, ensuring tobacco products are only sold to individuals over 21. Engaging those under 21 in tobacco sales is also prohibited.
- Ban on advertising and displays: Advertising of any tobacco products, including visible displays in retail outlets, is forbidden. Displays are considered a form of advertising under the new law, subjecting retailers to penalties.
- Prohibition on cultivation and production: The law bans the cultivation of tobacco plants, the production of tobacco products, and the import of tobacco seeds or parts that could be used for growing tobacco within the Maldives.
- Fines for illegal activities: The amendment introduces significant fines for illegal import, export, sale, and advertising of tobacco products, aimed at curbing unauthorised activities in the market.
The ratification of this amendment signals a robust step towards curbing tobacco usage, particularly among young people, and addressing the public health concerns associated with e-cigarettes and vaping. The law has been published in the Government Gazette, solidifying its status as part of the Maldives’ ongoing public health initiatives.
